Please read these Terms of Use carefully before using this site. By using this site, you signify your agreement with these Terms of Use. If you do not agree with any of the below Terms of Use, do not use this site. The Nova Scotia Gaming Corporation (the "NSGC") reserves the right, in its sole discretion, to modify, alter or otherwise update these Terms of Use at any time and you agree to be bound by such modifications, alterations or updates.
1. Trade Marks, Copyrights and Restrictions
(1) This site is controlled and operated by the NSGC. All material on this site, including, but not limited to images, illustrations, audio clips and video clips, is protected by copyrights and trade-marks which are owned and controlled by the NSGC or by other parties that have licensed their material to the NSGC. The NSGC may make changes to the materials contained on this site at any time without notice.
(2) The viewing or downloading of any content from this site grants you only a limited non-exclusive licence for use of such material solely for your own personal use. Material from this site may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way. Modification of the materials or use of the materials for any other purpose is a violation of the copyrights and other proprietary rights. For purposes of this Terms of Use Agreement, the use of any such material on any other Web site or networked computer environment is prohibited.
(3) You do not acquire ownership rights to any content distributed through this site.
2. Privacy
(1) The NSGC is very respectful about the privacy concerns of the visitors to its sites on the Internet. In these Terms of Use the term "Personal information" means any information about you as an identifiable individual including your name, an identifying number such as your driver's licence number, your birth date, your email address, or your credit card information. The NSGC does not automatically collect Personal Information from you when you visit this site. However, certain non-personal information is recorded by the standard operation of the NSGC's servers when you visit this site. This information is primarily used to provide an enhanced online experience for you. Information tracked includes the type of browser being used by you, the type of operating system in use by you and the domain name of the your Internet service provider. By having this information, Web pages optimized for your computer are automatically available to you. Other uses of this information include internal review of the number of visitors to this site but only in an aggregate and non-personally identifiable form.
(2) E-mail addresses, other Personal Information, and other information about you are known to the NSGC only when voluntarily submitted by you. Personal Information and other information provided by you is accessed and used by the NSGC only as set out in these Terms of Use and is not sold or otherwise transferred outside the NSGC.

3. Creation of Account and Password
(1) You may choose to create a user account to access certain services available through this site. If you choose to create a user account you will be asked to provide your email address as your username, as well as a password, during the registration process. This information is used to administer your account. For example, the NSGC will direct e-mail to registered users who have forgotten their password.
(2) You are responsible for maintaining the confidentiality of the password and account. You agree that you will be fully responsible for all activities that occur under your password or account. In the event you discover unauthorized access to or use of your account or password, you must notify the NSGC immediately. You are entitled and authorized to make use of the password and account solely for accessing the services available through this site and for purposes within the scope of these Terms of Use, such as viewing usage reports and editing your information.
(3) You are solely responsible for protecting your account and password. You must carefully select your password so that it cannot be easily guessed by anyone else. When choosing a password, you should not use: (a) a password you use for any other service; (b) your name or a close relative's; (c) your birth date, telephone number or address, or a close relative's; (d) your credit card number, or (e) your username/email address.
(4) You agree to keep your password confidential, and ensure that it is never disclosed, accidentally or otherwise, to anyone else. The NSGC is not liable for any claims, losses, actions, damages, suits or proceedings relating to the sharing of your account and password with others or your failure to take appropriate security measures.
(5) E-mail sent over the Internet is not secure and may be lost, intercepted, or altered. Except where another agreement with the NSGC says otherwise, you agree that the NSGC is under no obligation to accept or act on any instructions you provide to it by e-mail. If you send confidential information by e-mail, the NSGC will not be liable if it is lost or intercepted, altered or misused by someone else. If you send the NSGC e-mail, you agree that it may (at its sole discretion) respond to you by e-mail, and provide by e-mail any confidential information that you have requested; you also agree the NSGC will not be liable if the information it provides is lost or intercepted, altered or misused by someone else.

(1) If you create a user account you will have the ability to access certain additional services available on this site (the "Enhanced Services"), including an interactive self assessment tool to assist you in managing your gaming entertainment budget.

(1) The materials and services available on this site are provided "as is" and without warranties of any kind, either express or implied. To the fullest extent permissible pursuant to applicable law, the NSGC disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. The NSGC does not warrant that access to the materials on this site will be uninterrupted or error-free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or other harmful components. The NSGC does not warrant or make any representations regarding the use or the results of the use of the materials and services available through this site in terms of their correctness, accuracy, reliability or otherwise. Applicable law may not allow the exclusion of implied warranties, so the above exclusion may not apply to you.
(2) The material and services available on this site are provided solely for information purposes. The facts and data provided are believed to be reliable when posted. The NSGC cannot guarantee that they are accurate or complete or that they will be current at all times. The information and services available on this site are not intended to provide legal, accounting, tax, business or financial planning advice and should not be relied upon in that regard.
(3) Neither the NSGC nor its affiliated or related entities or its content providers are responsible or liable to you or to any person or entity whatsoever (including, without limitation, persons who may use or rely on any data/materials available from this site or to whom such data/materials may be furnished) for any loss, damage (whether actual, consequential, punitive or otherwise), injury, claim, liability or other cause of any kind or character whatsoever based on your use of this site, including your use of the information available on this site or your use of the Enhanced Services.
(4) The NSGC whether or not affiliated with sites which may be linked to this site (the "Linked Sites"), has not reviewed all of the Linked Sites and is not responsible for the content of any Linked Sites. The Linked Sites are for your convenience only and you access and use them at your own risk.
5. Jurisdictional Issues
(1) Unless otherwise specified, the materials in this site are presented solely for the purpose of providing information and materials to you regarding various gaming concepts and responsible gambling behaviours. This site is controlled and operated by the NSGC from its offices within the Province of Nova Scotia. The NSGC makes no representation that materials in this site are appropriate or available for use in other locations. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
(2) This agreement shall be governed by, construed and enforced in accordance with the laws of the Province of Nova Scotia, as it is applied to agreements entered into and to be performed entirely within such province. Any action you, any third party or the NSGC bring to enforce this agreement or, in connection with, any matters related to this site shall be brought only in the courts of the Province of Nova Scotia, and you expressly consent to the jurisdiction of the courts of the Province of Nova Scotia.
(3) If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
(4) This is the entire agreement between the parties relating to the matters contained herein and shall not be modified except in writing, signed by Provider.
